Terms of Service and User Agreement
These Terms of Service and User Agreement (“Terms”) are a binding agreement between you and Joshua Levine, doing business as AI CV Resumes (“AI CV Resumes,” “we,” “us,” or “our”). Please read them carefully.
1. Agreement, scope, and electronic acceptance
These Terms govern your access to and use of aicvresumes.com and its subdomains, the AI CV Resumes authenticated application, account portal, content-generation features, subscriptions, and related services (collectively, the “Service”). Our Privacy Policy is incorporated by reference and explains how we process personal information.
You accept these Terms electronically when you check the acceptance box during sign-up or in the authenticated application, purchase a subscription through a flow that references these Terms, or continue using the Service after an updated agreement takes effect where permitted by law. If you do not agree, do not create an account or use the Service.
2. Eligibility and authority
You must be at least 18 years old to use the Service. By accepting these Terms, you represent that you are 18 or older, have legal capacity to enter this agreement, and, if acting for an organization, have authority to bind that organization.
3. Accounts and credentials
You must provide accurate, current, and complete account information and keep it updated. Authentication is provided through Clerk and may include password or Google OAuth sign-in. You are responsible for safeguarding credentials, maintaining control of your connected Google account, and activity under your account. Promptly report suspected unauthorized access through the contact form or legal@aicvresumes.com.
4. AI-generated services
The Service uses artificial intelligence to parse an uploaded resume into editable fields and to generate general and tailored resumes, cover letters, answers to job-application or interview questions, and post-interview follow-up email drafts from information you provide. Parsing and generation are probabilistic: the same input may produce different results, and extracted fields or generated output may be incomplete, inaccurate, unsuitable, duplicative, or similar to content produced for another user.
5. Your verification responsibility
You are solely responsible for reviewing, editing, and verifying every extracted field, factual claim, and item of generated text before saving it or sending or submitting it to an employer or any other person. Follow-up emails are drafts only: the Service does not send mail, and you must review, edit, copy to your own mail client, and send each message yourself. Do not rely on the Service as the source of truth for your qualifications, history, or legal obligations. You remain responsible for your application materials and how you use them.
6. No employment or performance guarantees
AI CV Resumes does not guarantee applicant-tracking-system performance, ranking, interviews, responses, job offers, employment, compensation, or any other outcome. We do not guarantee that extracted fields or AI output will be error-free, complete, non-duplicative, original, or accepted by an employer.
7. Acceptable use
You may not use or attempt to use the Service to:
- invent or misrepresent qualifications, experience, education, identity, or authority;
- impersonate another person, commit fraud, deceive an employer, or violate applicable law;
- submit unlawful, harmful, defamatory, infringing, or privacy-violating content;
- infringe intellectual-property, confidentiality, publicity, privacy, or other rights;
- bypass authentication, security controls, service restrictions, or payment mechanisms; probe or disrupt the Service; or introduce malicious code;
- scrape, crawl, reverse engineer, make abusive automated requests, interfere with other users, or attempt to evade usage, security, or fair-use limits; or
- help another person do any of the prohibited acts above.
8. User content and license
As between you and AI CV Resumes, you retain ownership of uploaded resumes, information, text, and other content you provide (“User Content”). You represent that you have the rights and permissions needed to provide and use User Content through the Service. You grant AI CV Resumes and its service providers a limited, non-exclusive, worldwide license to host, store, reproduce, process, transmit, parse, format, and use User Content only as reasonably necessary to operate, secure, support, and maintain the Service and provide the extraction or output you request. This license ends when the content is deleted, except for limited retention permitted by the Privacy Policy or law.
9. Generated output
To the extent permitted by applicable law and subject to any third-party rights, AI CV Resumes assigns to you any rights it may have in output generated specifically for you. AI output may not qualify for copyright protection, may not be unique, and may resemble other content. You should expect to edit it. This section does not transfer rights in the Service, software, templates, branding, or other AI CV Resumes materials.
10. Service intellectual property
The Service, including its software, design, interfaces, branding, documentation, and non-user content, is owned by AI CV Resumes or its licensors and is protected by applicable law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for your own lawful job-search and career activities. You may not resell the Service, copy its protected elements, or use the Service or its output at scale to build, train, benchmark, or operate a competing product without written permission.
11. Free features and limits
Free features and generation limits are those displayed in the Service at the time of use. We may change free features, quotas, or availability prospectively. Attempts to circumvent displayed limits violate these Terms.
Free accounts receive three counted resume-parsing attempts per rolling 24-hour window. Invalid files are rejected before an attempt is reserved, and selected provider or service failures do not consume an attempt.
12. Paid subscriptions, renewal, cancellation, and refunds
The currently displayed paid-plan price is $15 per month. A paid subscription automatically renews each month until canceled. You authorize Stripe to charge the payment method on file for the recurring subscription price and applicable taxes. We may change prices prospectively by providing notice required by law; a price change applies no earlier than a future renewal.
Active paid and approved accounts have unlimited document generation and resume parsing without free-feature quotas. “Unlimited” applies only to application-level free-feature count and window quotas; all access remains subject to reasonable service, security, technical-capacity, and fair-use safeguards and these Terms.
Ordinary cancellation takes effect at the end of the current paid billing period, and paid access ordinarily continues until then. Except where applicable law requires otherwise, fees are non-refundable and cancellation does not create a prorated refund. Deleting your account immediately ends access to the Service, schedules subscription renewal cancellation at the end of the paid billing period, and does not create a prorated refund. Stripe may retain transaction or tax records as legally required.
13. Third-party services and links
The Service depends on third-party providers, including Clerk, Google, OpenAI, Turso/libSQL, Stripe, Vercel, Cloudflare, Sentry, and Resend. Their services may be governed by separate terms and privacy practices. Links to job postings, employer sites, and other external websites are provided for convenience; AI CV Resumes does not control or endorse their content or availability.
14. Privacy and account deletion
Our Privacy Policy describes collection, AI processing, service providers, retention, and your privacy choices. Necessary authentication and security technologies remain active to provide ordinary account functionality. Optional Vercel Web Analytics and Speed Insights run only after your affirmative permission, which you may withdraw through Privacy Settings without losing ordinary account functionality. You may delete your account through Clerk’s hosted account portal. Account deletion is intended to promptly remove user-owned records from live AI CV Resumes application tables, immediately terminate application access, and schedule mapped active Stripe subscriptions not to renew. Provider records and backups may remain under provider schedules or legal obligations.
15. Suspension and termination
We may limit, suspend, or terminate access when reasonably necessary to address a material breach of these Terms, fraud, abuse, security risk, nonpayment, provider restriction, or legal requirement. Where practical and appropriate, we will provide notice and an opportunity to cure. You may stop using the Service, cancel a subscription, or delete your account at any time. Sections that by their nature should survive—including ownership, disclaimers, liability, indemnification, and dispute terms—survive termination.
16. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. THESE DISCLAIMERS DO NOT EXCLUDE WARRANTIES OR CONSUMER PROTECTIONS THAT CANNOT LAWFULLY BE WAIVED.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI CV RESUMES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, LOST DATA, EMPLOYMENT DECISIONS, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI CV RESUMES’ TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS YOU PAID TO AI CV RESUMES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
18. Indemnification
To the extent permitted by law, you will defend and indemnify AI CV Resumes from third-party claims, damages, and reasonable costs arising from your unlawful use of the Service, your violation of another person’s rights through User Content, or your material breach of these Terms. This obligation does not apply to the extent a claim results from AI CV Resumes’ own unlawful conduct, negligence, or breach.
19. Florida law and courts
These Terms are governed by Florida law, without regard to conflict-of-law rules. Any dispute not resolved informally may be brought in a state or federal court located in Florida, and each party consents to those courts’ jurisdiction and venue. These Terms do not require arbitration and do not include a class-action waiver. If the law where you live gives you non-waivable consumer rights or permits you to bring a claim in another forum, those rights remain intact.
20. Changes, notices, and general terms
We may update these Terms as the Service or law changes. We will post the updated Terms with a new date and provide additional notice or request renewed acceptance for material changes where required. Changes apply prospectively. Notices may be provided through the Service, your account email, or the contact information you provide.
If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions remain effective. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, financing, business transfer, or by operation of law. Failure to enforce a provision is not a waiver. Neither party is liable for delay caused by events beyond reasonable control, except that payment obligations are not excused. These Terms and the incorporated Privacy Policy are the entire agreement concerning the Service and replace prior understandings on that subject.
